Over the past 15 years, e-commerce has experienced unprecedented growth, fundamentally transforming the way individuals procure goods and services. In response to this shift, businesses have embraced innovative online practices, strategies, and tools, often leveraging user data for targeted advertising. As we delve deeper into this digital era, striking a balance between maximizing e-commerce gains and safeguarding consumer rights remains a critical challenge.
Dark Patterns refer to design features that are strategically employed to deceive or manipulate users, directing them toward actions that benefit an online service's bottom line but are often detrimental to users or contrary to their original intentions. Coined by Harry Brignull in 2010, Dark Patterns have since become a focal point for researchers uncovering a myriad of deceptive tactics, each geared towards achieving nefarious outcomes through user manipulation.
These Dark Patterns are the online evolution to decades of deceptive practices in direct mail marketing. While scams through mail persist, the digital realm has witnessed a surge in deceptive techniques, largely facilitated by Dark Patterns. What distinguishes digital deception is its freedom from physical constraints and costs, making these online tricks and traps an even greater menace compared to their traditional paper-based counterparts.
Digital tricks and traps, often working in tandem, encompass a diverse array of strategies within Dark Patterns. These deceptive tactics involve online sleights of hand, leveraging visual misdirection, confusing language, hidden alternatives, or fabricated urgency to guide users toward or away from specific choices. Examples include employing buttons with consistent styles but varying language, using double-negative language in checkboxes, incorporating disguised ads, or creating artificial time pressure-all designed to deceive users into clicking, subscribing, consenting, or making a purchase.
In India, the Central Consumer Protection Authority ("CCPA") enacted the "Guidelines for Prevention and Regulation of Dark Patterns, 2023" on November 30, 2023("Guidelines"). The Guidelines were introduced under the powers granted by Section 18 of the Consumer Protection Act, 2019("CPA"). The CCPA had initially released a draft of the Guidelines on September 07, 2023 and after stakeholder consultations and public comments, the final version was officially notified.
The Department of Consumer Affairs ("DoCA") played a role in shaping the Guidelines by engaging in discussions with stakeholders, including e-commerce platforms. On June 30, 2023, the DoCA sent a letter to major online platforms, advising them to avoid incorporating designs or patterns in their online interfaces that could be considered Dark Patterns and unfair trade practices.
The primary goal of the Guidelines is to regulate practices that could manipulate or deceive consumer choices, particularly those involving deceptive techniques in user interfaces and web designs. The focus is on fostering fair and transparent interactions between consumers and online platforms, with an emphasis on consumer protection in the digital space.
The Guidelines, cast a wide regulatory net, encompassing platforms systematically offering goods or services, advertisers and sellers operating within the Indian market. The explicit prohibition against engaging in Dark Patternspractices underscores the regulatory intent to curb deceptive design strategies across diverse entities.
The Guidelines, as per Clause 2(e), defines "Dark patterns" as, "any practices or deceptive design patterns using UI/UX (user interface/user experience) interactions on any platform; designed to mislead or trick users to do something they originally did not intend or want to do; by subverting or impairing the consumer autonomy, decision making or choice; amounting to misleading advertisement or unfair trade practice or violation of consumer rights."
The definition of Dark patterns is intentionally non-exhaustive. The Digital Personal Data Protection Act, 2023 (DPDP Act) mandates that all entities and online platforms must obtain clear, specific, and well-informed consent from individuals before processing their personal data. Individuals have the right to withdraw their consent at any time, and the process of withdrawing consent should be as simple as giving consent. The Guidelines, in conjunction with the DPDP Act, strive to ensure that users are not coerced or deceived into sharing personal data during the consent process. Basket sneaking is characterized by the inclusion of additional items, services, or donations at the checkout without user consent. The total payable amount ends up exceeding the user's original intention, unless transparently disclosed as necessary fees.
Confirm shaming entails using phrases, videos, or audio to induce fear, shame, ridicule, or guilt in users, influencing them to make specific decisions. This could manifest in phrases like "I will stay unsecured" when users don't include insurance in their cart.

Drip pricing involves revealing elements of prices subtly or post-confirmation, charging more than initially disclosed, advertising products as free without revealing in-app purchase requirements, and preventing users from accessing paid services unless additional purchases are made
Disguised advertisement refers to the deceptive practice of presenting advertisements as different types of content, such as user-generated content or news articles. It underscores the importance of clear disclosure and transparency in advertising practices.
Nagging is characterized by overwhelming users with repeated requests, information, or interruptions unrelated to their intended transactions. This could include persistent prompts to download apps, provide phone numbers, or turn on notifications.
Involves deliberate use of confusing or vague language, such as employing misleading wording or double negatives, with the aim of misguiding or misdirecting users, leading them away from desired actions or coercing specific responses.
